These Terms of Service ("Terms") govern your use of the "Your Next Home" website (the "Website") and any services provided by Your Next Home (the "Services"). By accessing or using the Website or Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms or the Privacy Policy, please do not use the Website or Services.

The purpose of these Terms is to ensure a transparent and secure environment for all users while protecting the rights of both the company and its users. Your Next Home is committed to providing a platform for users to buy, sell, or rent properties in Kenya. Compliance with these Terms is essential for maintaining the integrity of the platform and ensuring a positive experience for all parties involved, in line with Kenyan laws, including the Data Protection Act, 2019 and the Consumer Protection Act, 2012.

2. Acceptance of Terms
By accessing or using the Website or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. You also consent to receive communications from Your Next Home electronically, including emails and notices posted on the Website. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not agree with these Terms or the Privacy Policy, you are not authorized to use the Website or Services. You represent that you are at least 18 years old or have the legal capacity to enter into these Terms. Your continued use of the Website or Services constitutes your acceptance of these Terms and any updates, as notified..

3. User Responsibilities
All users of Your Next Home are expected to use the Platform responsibly, honestly, and in compliance with all applicable laws. You agree to the following obligations when using our You agree to the following obligations when using our Platform:

i. Provide Accurate Information: You agree to provide true, current, and complete information about yourself during account registration and in all communications on the Platform . This includes your personal details and, if you are listing a property, accurate details about the property (location, price, features, terms, etc.). You must promptly update any information that becomes outdated or incorrect. Misrepresenting your identity or listings is strictly prohibited.

ii. Account Security: If you create an account, you are responsible for maintaining the confidentiality of your login credentials. You must keep your password secure and not share it with anyone . You agree to notify us immediately if you suspect any unauthorized access to your account or breach of security. You are accountable for all activities that occur under your account, whether or not authorized by you, and you may be held liable for losses caused by failing to safeguard your credentials . Your account is personal to you; do not sell, transfer, or allow others to use your account (except authorized personnel if you are a business user, in which case you remain responsible for their actions) .

iii. Comply with Laws and Regulations: You must use the Platform in compliance with all applicable laws and regulations. This includes the laws of Kenya (the jurisdiction of our registration and operation) and, if you are accessing from another country, any local laws of that location. You are solely responsible for ensuring that your use of the Platform (and any transactions you engage in) is lawful. For example, you agree to adhere to all real estate laws and regulations, such as property disclosure requirements, landlord-tenant laws, housing regulations, and anti-discrimination laws that apply to property listings and transactions in Kenya or in the property’s location. You also agree to comply with any anti-fraud, anti-money laundering, or anti-corruption laws that may apply to property transactions.

iv. Use for Intended Purposes:
You agree to use Your Next Home only for its intended purposes – facilitating property listings, searches, and related transactions. All users (whether property listers or prospective buyers/tenants) must use information obtained from the Platform solely for making legitimate inquiries about properties or conducting real estate transactions. You must not use the Platform or any information from it for competitive intelligence, to build a similar or competitive service, or for any purpose that is not expressly permitted by these Terms.

v. Specific Responsibilities for Property Listers (Owners/Agents/Managers): If you are a property owner, landlord, real estate agent, property manager, or developer listing a property on the Platform, you additionally agree to:

  • Authority and Legitimacy: Only list properties that you own or are legally authorized to sell or rent out. By listing a property, you represent and warrant that you have the lawful right to market and transfer an interest in that property (as seller or landlord) and that no other party’s consent is required, or such consent has been obtained. You further represent that the property is not subject to undisclosed liens, disputes, or legal restraints that would prevent a sale or lease. If you are acting as an agent/manager, you certify that you are duly authorized by the property owner to act on their behalf.
  • Licensing and Compliance: Ensure that you have any required licenses or registrations to act as a real estate agent or property manager as per Kenyan law (or the law of the property’s location). You are responsible for complying with professional regulations and standards applicable to real estate advertising and transactions.
  • Accurate Listings: Provide complete, truthful, and up-to-date information for each listing. All descriptions, photographs, prices, availability dates, and other details must accurately reflect the current status of the property. Do not exaggerate, omit critical facts, or provide misleading information. If information changes (for example, the property is sold or rented, or details change), you must promptly update or remove the listing to keep information on the Platform accurate.
  • No Fraud or Misrepresentation: You must not post any fraudulent listings. Every property you list must be real and available (unless clearly marked as an example or pre-launch). You will not list properties without the intention to genuinely rent or sell them. Submitting fraudulent, false or non-existent property listings is strictly forbidden and will result in removal of the listing and possible account termination.
  • Respect for Prospective Buyers/Tenants: You will engage with interested parties in good faith. This means responding to inquiries in a timely and honest manner, honoring any commitments made in communications (such as agreed viewing appointments or negotiations), and not discriminating against prospective tenants or buyers on any unlawful basis (e.g., based on race, religion, gender, etc., in violation of applicable law). You must handle any personal data of interested parties in compliance with privacy laws (see our Privacy Policy), and only use it for the purpose of facilitating the transaction for which it was provided.

vi. Specific Responsibilities for Buyers and Tenants:If you are using the Platform as a prospective buyer or tenant, you additionally agree to:

  • Personal Use of Information: Use property listing information solely for your personal decision-making in purchasing or renting property. You must not use owners’ or agents’ contact details obtained from the Platform for any purpose other than inquiring about or pursuing a legitimate property transaction. For example, you must not harvest listing contact information to send unsolicited marketing, spam, or offers unrelated to that listing.
  • Due Diligence: Conduct appropriate due diligence before entering into any property transaction. The Platform provides information to help you discover properties, but you are responsible for verifying important details about a property and the counterparty. This includes visiting the property (when possible), reviewing contracts, confirming ownership and title, checking for encumbrances or necessary permits, and obtaining independent professional advice (legal, financial, inspection, etc.) as needed. You assume all risk for any decisions you make based on information on the Platform, and you should not rely solely on the listing content without verification.
  • Legal Obligations in Transactions: Ensure that any purchase or lease you agree to is formalized in accordance with the law. For example, sales of land or homes typically require written contracts and government registration; leases may require written agreements and perhaps stamp duty. It is your responsibility to follow through with signing all necessary documents and fulfilling legal requirements (with the other party) outside the Platform. The Platform may facilitate initial contact and negotiation, but it does not replace the need for proper legal contracts. You should seek legal counsel if you are unsure about your obligations.
  • Financial Responsibility: Only make offers or commitments if you have the intention and ability to follow through. If the Platform (now or in future) allows you to make payments such as deposits or rent online, you must ensure sufficient funds and comply with payment instructions. You also agree not to attempt to enter into any illicit financial arrangements (such as money laundering schemes) via the Platform. Any payments you make are at your own risk, subject to any escrow or protection mechanisms we may offer (if any), which will be explained separately if provided.

vii. Respectful Communication and Conduct: All users should interact with one another politely and professionally. Whether you are a landlord/agent communicating with a potential tenant or a buyer contacting a seller, you agree to refrain from abusive, harassing, or discriminatory language. You also agree to use any messaging systems or contact forms on the Platform solely for genuine property inquiries and responses – not for unsolicited advertising, harassment, or sharing irrelevant content.

viii. Accountability: You are responsible for any breach of these Terms and for the consequences (including potential legal liability) of any such breach. If you cause harm or loss to the Company or any other user through your use of the Platform, you may be required to indemnify (compensate) the affected party, as allowed by law. (See Limitation of Liability for how Your Next Home limits its liability to you).

In summary,all users must use Your Next Home in good faith, with honesty and diligence. By fulfilling these user responsibilities, you help maintain a trustworthy community and smooth functioning of the Platform.

4. Prohibited Activities
To protect our community and service, we have established clear rules about behaviors that are not allowed on the Platform. You agree NOT to engage in any of the following prohibited activities:

i. Illegal or Fraudulent Use: Do not use the Platform for any purpose that is illegal, fraudulent, or unauthorized . This includes (but is not limited to) using the Platform in connection with any unlawful activities, schemes to defraud others, or to promote or facilitate any criminal activity. You must not post content or listings that involve illegal goods or services. Any attempt to use the Platform to launder money, engage in bribery or corruption, or violate any law or regulation is strictly forbidden.

ii. Providing False or Misleading Content:You may not post false, misleading, or deceptive information on the Platform. This means no fraudulent property listings, no false identities or impersonation, and no doctored or misleading photos. You must not misrepresent the location, features, pricing, availability, or any other material detail of a property. Impersonating any person or entity (for example, posing as another user, a Company employee, or a nonexistent agent) or misrepresenting your affiliation with any person or entity is prohibited. All content you provide must be truthful and accurate to the best of your knowledge.

iii. Intellectual Property Infringement:Do not post or distribute content on the Platform that infringes the intellectual property or proprietary rights of others. This includes uploading photographs, descriptions, floor plans, or other materials that you do not have the right to use. You must not copy or reuse content from other listings or websites without permission. If you use third-party content (such as a photograph taken by someone else) in your listing, ensure you have obtained the necessary rights. Pirating or scraping images or text from other sources to use on our Platform is forbidden and may result in removal of content and account penalties.

iv. Unlawful, Harmful, or Objectionable Content:You are not allowed to publish any User Content (including property descriptions, comments, or any other material) that is unlawful, harmful, or otherwise objectionable. Prohibited material includes content that is defamatory (damages someone’s reputation with false information), obscene or pornographic, indecent, hateful, harassing or threatening, invasive of privacy, or that incites violence or crime. Additionally, any content that discriminates against individuals or groups on the basis of race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other characteristic protected by law is strictly prohibited. We reserve the right to remove any content that we deem offensive or inappropriate, even if it is not specifically listed here.

v. Data Mining and Scraping: You must not use any automated means to access or extract data from the Platform without our prior permission. Prohibited automated activities include using bots, spiders, scrapers, crawlers, or any other data mining or screen-scraping tools to harvest listings or other information from the site . This also extends to not using any manual processes that operate at a rate beyond normal usage or that copy large portions of the site (for example, systematically copying all listings). Such activities can degrade our service and violate our rights. We reserve the right to detect and block any such activities.

vi. Spamming and Unsolicited Communications:You may not use the Platform’s communication tools (or information gleaned from the Platform) to send unsolicited bulk communications, spam, chain letters, pyramid schemes, or any form of unwanted solicitation. For example, you must not harvest email addresses or phone numbers from listings to send newsletters or advertisements without consent. You also must not post repetitive content or the same listing multiple times in a way that floods the Platform. All communications with other users (via messaging features or externally using contact info obtained here) should be relevant to genuine real estate inquiries or responses.

vii. Interference and Disruption: Do not interfere with the proper working of the Platform or disrupt the experience of other users. Prohibited disruptive activities include:

  • Introducing or transmitting any harmful code, viruses, worms, or malware that could damage or disrupt the Platform’s software or hardware.
  • Attempting to hack, penetrate, or test the vulnerability of the Platform’s security or authentication measures without authorization (this includes attempting to gain access to other users’ accounts or data).
  • Performing any action that imposes an unreasonable or disproportionately large load on our infrastructure, such as launching a denial-of-service (DoS) attack or using automated systems to send excessive requests.
  • Manipulating the Platform’s functionality: for example, using bots to create fake accounts or to inflate view counts, or attempting to circumvent any access controls or payment mechanisms.
  • Blocking or obscuring advertisements or safety features on the site, or otherwise interfering with the way the Platform is intended to display or function for other users.

viii. Unauthorized Commercial Use: You may not use the Platform for purposes of unsolicited advertising or marketing to users without our permission. This means you shouldn’t post advertisements for products or services (other than the property listing itself if you are a seller/landlord) or use user information obtained from the Platform to market external businesses. Additionally, reselling or transferring access to the Platform (e.g., selling your account or running a paid service using our site’s information) without our consent is prohibited.

ix. Circumvention and Improper Transactions:You must not intentionally circumvent the Platform’s processes. For instance, if the Platform introduces features for making payments or signing agreements, you should not misuse those features or deliberately avoid them in order to evade fees or policies that apply. Likewise, you should not encourage or solicit other users to complete a transaction off-platform in a manner that violates our policies or deprives us of any compensation due for our services. (Note: Standard practice of meeting or finalizing a property transaction in person or through legal channels is acceptable; this bullet refers to malicious circumvention such as using the Platform to find leads but then engaging in prohibited arrangements).

x. Other Unethical Behaviors:In summary, any activity that is unethical, unlawful, or in bad faith toward other users or the Platform is forbidden . This includes attempting to exploit the Platform or any user, posting content meant to scam or phish, or any misuse not explicitly listed here but which common sense would consider inappropriate in a professional real estate marketplace.

xi Consequences of Prohibited Conduct:If you engage in any of the above prohibited activities (or otherwise breach these Terms), Your Next Home may take one or more of the following actions, as appropriate: remove or modify your content, suspend or terminate your user account, ban your access to the Platform (temporarily or permanently), and/or report you to law enforcement or regulatory authorities if the behavior is suspected to be unlawful. We also reserve the right to take legal action to enforce these Terms or seek remedies (such as damages or injunctions) for the violation. You agree that we are not liable for any loss you suffer arising from our removal of your content, account suspension, or other enforcement actions in response to your breach of these Terms.

5. User Content
Any content that you submit to the Website, such as property listings, reviews, or other information (collectively, "User Content"), remains your property. However, by submitting User Content, you grant Your Next Home a worldwide, royalty-free, perpetual, irrevocable, and non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content for the purpose of operating and promoting the Website and Services.

You represent and warrant that:

  • You have the right to grant such a license.
  • The User Content does not infringe on any third-party rights, including intellectual property rights.
  • The User Content complies with these Terms and all applicable laws, including accurate representations as required by the Consumer Protection Act, 2012.

Your Next Home reserves the right to remove or edit any User Content that violates these Terms or applicable laws, without prior notice.

Our Proprietary Materials: The Platform and all material on or available through it (excluding your own User Content) are the property of Your Next Home or its licensors, and are protected by copyright, trademark, and other intellectual property laws. This includes the design and layout of the website; all text, graphics, images, video or audio content produced or provided by us; the compilation of property listings and databases; the software and code that operates the site; and the trademarks, logos, and branding of Your Next Home. For example, all site features and content such as our logos, color schemes, icons, the “Your Next Home” name, and any content created by our team (such as articles or market data) are part of our intellectual property (“IP”). All content on the site is owned or licensed by Your Next Home, unless otherwise indicated, and is protected by local and international intellectual property laws .

Your Limited Right to Use Our IP: We grant you a limited, revocable, non-exclusive, and non-transferable license to access and use the Platform and our content for your personal use (or internal business use, if you are a real estate professional) in accordance with these Terms. This means you may browse listings, print or download copies of content for your personal use, and use our services to facilitate real estate transactions. Any commercial use of our content outside of the intended use on our Platform requires our prior written permission. Except as expressly permitted by these Terms or by law, you must not:

  • Copy, reproduce, modify, or create derivative works of the Platform or any of its content.
  • Distribute, publicly display, or publicly perform any content from our site (e.g., do not take images or text from our site and publish them elsewhere as your own).
  • Sell, resell, or exploit the Platform’s content or access for any commercial purpose (outside of legitimate real estate transactions as enabled by the Platform).

“Your Next Home” and our associated logos and slogans are trademarks/service marks owned by us. All other product or company names that may appear on the Platform (for example, names of partner organizations or advertisers) may be trademarks of their respective owners. You are not granted any right or license to use any trademarks found on the Platform. Unauthorized use of our trademarks is strictly prohibited. You may not remove, obscure, or alter any trademark, copyright, or other proprietary notices on any content obtained from the Platform.

Third-Party Materials:
The Platform might contain content or software provided by third parties (for example, map services, analytic tools, or libraries). All rights in third-party content or tools remain with their respective owners, and they may be subject to additional terms imposed by those owners. Termination
